The present conditions of sale are concluded between, on the one hand, Natural Surf Lodge SARL, whose registered office is at 3 avenue de la Grande Plage 40510 Seignosse, registered in the DAX Trade and Companies Register under the SIRET number 49752187200026, hereinafter referred to as Natural Surf Lodge, and, on the other hand, any individual or legal entity wishing to purchase a service from Natural Surf Lodge via the Internet site (www.naturalsurflodge.com), hereinafter referred to as the purchaser/customer/trainee.
Object
The present conditions of sale are intended to define the contractual relationship between Natural Surf Lodge and the purchaser, and the conditions applicable to any purchase of services made through the Natural Surf Lodge merchant site. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale shall prevail over any other general or special conditions not expressly approved by Natural Surf Lodge.
Natural Surf Lodge reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer's order.
Engagement qualité de Natural Surf Lodge
Natural Surf Lodge undertakes to implement a protocol specific to the health situation linked to covid19.
As part of the Qualité Tourisme™ approach, Natural Surf Lodge undertakes to provide in terms of quality of welcome, teaching, supervision and safety, services in line with the needs of the trainees and the national Qualité Tourisme™ referential. Similarly, the necessary equipment (wetsuits, boards, etc.) will be provided to trainees during lesson hours. Our courses comply with the quality charter of the FFS French Surf School label.
Natural Surf School has held the Qualité Tourisme™ mark since 2013, a mark renewed in 2016 for 5 years, and is committed to paying careful attention to both tourists-trainees and the coaching team.
Trainee commitment
Trainees agree to abide by the Covid-19 charter.
By booking a service with Natural Surf Lodge, surfers of legal age, as well as underage surfers and their parents, accept the risks associated with surfing under normal conditions.
The participant declares that he/she is in good health, can swim 25 meters and is fit to surf. The participant agrees to abide by the internal regulations and safety instructions of Natural Surf Lodge and its staff, and declares that he/she has no medical or other contraindications to taking part in the activity. Under no circumstances can Natural Surf Lodge be held responsible for any physical or other consequences resulting from failure to declare any contraindications.
Insurance
Natural Surf Lodge certifies that it has taken out professional insurance RC PRO GAN n°A04049081439030, covering the risks associated with its activity. In the event that the trainee considers that the guarantees offered by the Natural Surf Lodge structure insurance are not suitable for the activity carried out, it is up to the trainee to take out additional guarantees.

These services are provided within the limits of availability and human resources.
Rates
The prices of the services listed on the website are net prices in euros taking into account French VAT. Natural Surf Lodge reserves the right to change its prices at any time, provided however that the price on the site on the day of the order will be the only one applicable to the buyer.
Reservations
The confirmation of the reservation entails acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver to invoke its own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will be proof of the transaction. Confirmation will be signed and acceptance of the operations carried out.
Natural Surf Lodge will communicate the confirmation of the registered reservation by e-mail.
Ways of payment
A deposit of 25% is required to finalize a reservation. This deposit and all payments may be made at the option of:
- by credit card (online on the website);
by bank transfer;
by check (payable to Natural Surf Lodge BP 22 40510 Seignosse);
by holiday vouchers (vouchers accepted up to a maximum of 200 euros);
in cash.
Proofs of reservation and archiving
Natural Surf Lodge will archive reservations and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code and of 3bis I of Article 286 of the General Tax Code.
The computerized data stored by Natural Surf Lodge will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
An invoice can be issued by simple written request (email).
Responsibility for data related to online sales
Natural Surf Lodge, in the online sales process, is only bound by an obligation of means; its liability shall not be incurred for damages resulting from the use of the Internet network such as loss of data, intrusion, virus, disruption of service, or other unintentional problems.
Intellectual property
All elements of the Natural Surf Lodge website and social networks are and remain the intellectual and exclusive property of Natural Surf Lodge SARL.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether visual or sound.
Any simple or hypertext link is strictly prohibited without the express written agreement of Natural Surf Lodge.
Personal data
In accordance with the law, personal information about buyers may be subject to automated processing. Natural Surf Lodge is registered with the CNIL (Commission Nationale d’Informatique et des Libertés) under number 1838176.
Natural Surf Lodge reserves the right to collect information about buyers and may share the collected information with business partners.
Buyers may object to the disclosure of their contact information by notifying Natural Surf Lodge in writing. Users also have the right to access and rectify data concerning them.
Right to the image
By registering, you authorize Natural Surf Lodge to use the photos and/or films of your image made during your internship, for the realization of all advertising documents and this, without financial consideration.
Litiges
These conditions of sale online are subject to French law. In the event of a dispute, jurisdiction is vested in the Commercial Court of Dax.

Conditions of sale of surf lessons
Liability
Surf lessons and courses are sold at the price indicated on the website. For minors, a parental authorization must be completed either on site or online.
Trainees must not suffer from any contraindications to surfing and must report any health problems, even if mild, at the time of registration.
For all surf courses, unit courses for minors, parents or legal guardians acknowledge and accept that the children/adolescents accommodated are supervised by qualified teachers and under their responsibility during the surf course(s).
Outside the class, children/teenagers enjoy the meeting point of the surf school hut Natural Surf School (cloakroom, parasols, information, games available, picnic etc...) but remain under the responsibility of their parents or legal representatives.
For half-day or continuous day internships, legal officers will have to sign the half-day or continuous day form.
For surfing lessons with equipment available, the trainees acknowledge having read the rental conditions and undertake to respect them.
Conditions for cancelation
In case of bad weather conditions (lack of waves, too strong sea, pollution,...) if the courses cannot be carried out, the trainee will be warned of any cancelation by telephone or SMS as soon as possible of these possible changes, and will then receive a credit corresponding to the amount of the sums committed when booking the activity. This credit may be used for a subsequent reservation or refunded on request if the service could not be performed during the stay.
No additional compensation will be paid. Classes not completed by the customer will not be refunded. A traineeship started and interrupted because of the trainee cannot be reimbursed, unless there is a medical problem (proof) or if the person's place has been replaced by another trainee.
Conditions for renting surf equipment
Rented gliding equipment is under the sole responsibility of the customer as soon as he takes possession of it. In addition, it acknowledges having read the terms of the rental of such equipment and undertakes to comply with them:
The client will ensure its preservation and will use it in all circumstances by behaving like a good father. The person making the rental shall be responsible for taking possession of the leased equipment.
The equipment rented is intended for the sole use of the customer, without any possibility of subrental, or loan even for free. The customer is the only judge of his ability to use the leased equipment.
He certifies to be able to use the leased material and undertakes to use it carefully, without danger to third parties in accordance with the regulations in force.
Compliance with the regulations: the tenant undertakes to comply with the beach regulations and in particular the prohibition of surfing or body boarding with fins, between the blue flags (bathing area).
In addition, the tenant is reminded that surfing is a risky sport, which requires the ability to swim and which directly depends on the conditions of the oceanic environment, specific natural environment. The tenant acknowledges to rent the equipment at his own risk.
All equipment offered for rental is recognized to be in good condition and must be returned as such. Any deterioration, whatever the cause, will give rise, in addition to the cost of the rental, to the payment of replacement or refurbishment costs, up to the maximum value of the new equipment.
Liability of the tenant in the event of bodily or material damage caused by the use of the rented equipment in his custody (Articles 1383 and 1384 of the Civil Code)
The rental fee will not be refunded if the return of equipment is done earlier than planned.
Any overtime will be charged as a full period (hour, half-day...)
On his return, the equipment must be in perfect condition: rinse suit, desanded board, detached leash.
Cancelation before the pick-up of the equipment: the customer has a withdrawal period of 7 days from the confirmation of the reservation. After the 7 days of withdrawal, the deposit or the entire amount of the rental will be kept by the Natural Surf School. However, an equity on the rental of equipment may be established.
Cancelation after pick-up of equipment: in case of illness or accident occurring during the rental period, the rental conditions remain applicable. Only equipment rented by the person concerned can be returned and will then be billed in proportion to the number of rental days actually carried out, subject to presentation of a medical certificate.
Special conditions of sale for surf camps Natural Surf Lodge
Registration for one of the surf services presented on our website implies knowledge and acceptance of the general conditions of sale above and the specific conditions of the surf school and the following specificities:
Cancelation by the trainee
In the event of cancelation by the trainee, it will be subject to the conditions set out below:
- any cancelation of the stay occurring more than 30 days before the date of commencement of the training period shall entail the refund of the advance payment;
any cancelation of the trainee’s share occurring less than 30 days before the start date of the traineeship shall result in the loss of the total amount of the advance payment (25%);
any cancelation by the trainee occurring less than 10 days before the date of the start of the traineeship shall result in the payment of the entire stay. If this cancelation is linked to a medical problem, the trainee or his representative can use his insurance to get reimbursed. The Natural Surf Lodge undertakes to provide all proof of commitment and payment of said stay.
the failure to show and/or the waiver of the stay and/or the early departure of the trainee amounts to a cancelation, and will result in the full payment of the stay without any possible derogation.

Cancelation due to Natural Surf Lodge
Natural Surf Lodge reserves the right to modify the services and prices of stays or to cancel stays in the event of external events beyond its control.
In this case, the trainee will not be subject to the cancelation conditions. The deposit paid for the stay will then be fully refunded.
In this case, the trainee will be informed at the latest 7 days before the start date of the stay.
Transport of trainees
(in the case of use of a vehicle within the scope of the services offered)
Natural Surf Lodge is committed to transporting interns in accordance with applicable regulations:
- drivers holding the necessary license
vehicle insurance cover
respect of the maximum number of passengers
vehicle clean and in good mechanical condition
